Integrated Marketing warrants only to the original Purchaser that under normal use, care and service, the Equipment (except as otherwise provided herein) shall be free from defects in material and workmanship for one year from the date of original invoice. External hoses, remote control modules, adapters and all other attachments, supplies and consumables (except as otherwise provided herein) are warranted for 90 calendar days from the date of original invoice. Filter elements are not warranted. Printed circuit boards purchased from, but not installed by Seller are not warranted.
SELLER’S OBLIGATIONS UNDER THIS WARRANTY ARE LIMITED SOLELY TO THE REPAIR OR, AT SELLER’S OPTION, REPLACEMENT OF EQUIPMENT OR PARTS WHICH TO SELLER’S SATISFACTION ARE DETERMINED TO BE DEFECTIVE AND WHICH ARE NECESSARY, IN SELLER’S JUDGEMENT, TO RETURN THE EQUIPMENT TO GOOD OPERATING CONDITION. NO OTHER WARRANTIES EXPRESS OR IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SHALL APPLY AND ALL SUCH WARRANTIES ARE HEREBY EXPRESSLY DISCLAIMED.
This warranty does not cover (and separate charges for parts, labour and related expenses shall apply to) any damage to, malfunctioning, inoperability or improper operation of the Equipment caused by, resulting from or attributable to:
- Abuse, misuse or tampering.
- The warranty is not transferable from one user/customer to another.
- The seller will not be responsible for loss of data on the PC under any circumstances. Customers are encouraged to back up all data stored on the hard disk of their PC before giving the PC for service.
- Alteration, modification or adjustment of the Equipment by anyone other than Seller’s authorized representatives
- Improper or negligent use, application, operation, care, cleaning, storage or handling. (Contaminated with dirt, sand, water or any other substance that may damage electrical, pneumatic and hydraulic components)
- Any software that accompanied the equipment is on an “as is” basis. The seller does not warrant the operation of any or all the software programs pre-loaded or added to the equipment. Neither title nor intellectual property rights, except for the limited license rights granted in this Section, are transferred to you. You may not decompile, reverse engineer, disassemble, copy, adapt, translate or modify the Software. You also may not resell, lease, sublicense or otherwise transfer the Software to any third party. We reserve the right to terminate this limited license at any time.
- The seller’s warranty does not entail a warranty of functionality or any obligation to repair or replace a defective computer, if that defect is a result of physical breakage, improper installation or connections, electrical faults external to the product, software induced problems (e.g. Virus attacks), abuse or unauthorized modification of the product.
- All warranties are subject to visual / photographic inspection of the product by the seller to determine if valid.
- In terms of section 55(3) of the CPA There is no general right of return. A change of heart is not a legal reason to return an item. The direct marketing “cooling-off” period is for a period of 5 days after receiving the goods.
- Damages caused due to acts of force majeure. Fire, water, wind, lightning or other natural causes.
- First attempts to determine the cause of the defect or fault on the seller’s equipment shall be undertaken by phone or by electronic data transmission (i.e., e-mail), with the aim of resolving the issue. The seller reserves the right to send replacement parts or units to You so that You can fix the faulty equipment through instruction via telephone or electronic data transmission. If this is not successful, the seller will repair or replace the equipment, at the seller’s option.
- The Warranty does not cover consumables or parts of limited regular functionality due to their natural wear and tear.
- Any and all lift related claims will require the following documentation: Installation certificate, maintenance logs and load test certificate. If the following cannot be presented this will void the warranty.
- The rights granted by this Warranty shall not include the right of the Warranty beneficiary to claim any lost profits in connection with defects of the device. The seller shall not be held responsible for any material or financial losses caused by the defective product.
- In the event equipment is not installed according to specification warranty will be void. The seller reserves the right to request all maintenance and installation certificates. All products not installed by an approved installer / reseller will void warranty.
- The replacement of equipment shall be supplied without accessories and supplies
- The seller reserves the right to demand from You the original purchase receipt of the equipment. Please note that the place and date of purchase must be indicated legibly.
- The physical condition of the equipment is also taken into consideration before any warranty decisions are made for replacements or exchanges, especially within the first 30 days from the purchase date.
- Adverse environmental conditions, including, without limitation, excessive heat, moisture, corrosive elements, or dust or other air contaminants, radio frequency interference, electric power failure, power line voltages beyond those specified for the equipment, unusual physical, electrical or electromagnetic stress, and/or any other condition outside of Seller’s environmental specifications, load shedding , power surge.
- Use of the Equipment in combination or connection with other equipment, attachments, supplies or consumables not manufactured or supplied by Seller.
- The seller holds the rights to request all maintenance / service documents in the event documents cannot be produced warranty will be void.
Repairs or replacements qualifying under this Warranty will be performed on regular business days during Seller’s normal working hours within a reasonable time following Purchaser’s request. All requests for Warranty service must be made during the stated Warranty period. This warranty is non-transferable.
